These Terms are an agreement between you and [OPERATOR NAME / LLC] (“Smoochie”, “we”, “us”) for your use of smoochie.ai. By creating an account or using Smoochie, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use Smoochie.
1. You must be 18 or older
Smoochie is for adults only. By using it you confirm you are at least 18 years old and old enough to agree to these Terms where you live. We may close any account we believe belongs to a minor.
2. What Smoochie is
- Smoochie lets you chat with fictional characters powered by artificial intelligence. The characters are not real people, and their messages and images are generated automatically.
- AI can be wrong, inconsistent or surprising. Don't rely on anything a character says as fact or advice.
- Smoochie is entertainment, not therapy, medical, legal or financial advice. If you are in crisis or thinking about harming yourself, contact local emergency services or a crisis line (in the US, call or text 988).
3. Your account
Keep your login details secure and don't share your account. You are responsible for activity on it. Smoochie is currently an invite-only beta: we may approve, decline or revoke access at our discretion.
4. Acceptable use
You agree not to use Smoochie to:
- Create, request or share any content involving minors or anyone who appears to be under 18. We report apparent child sexual abuse material to the authorities.
- Depict or impersonate real, identifiable people, or create non-consensual intimate content.
- Promote violence, terrorism, self-harm, hate or harassment, or plan anything illegal.
- Try to bypass our safety systems, limits or access controls, including by manipulating the AI (“jailbreaking”).
- Scrape, resell or automate access to the service, or interfere with it or other users.
- Break any law that applies to you.
We may review content flagged by our systems, remove content, and suspend or terminate accounts that break these rules.
5. Content
You keep any rights you have in what you write. You give us permission to store, process and display your content, and to send it to our AI providers, as needed to run Smoochie. Characters, portraits and the service itself belong to us. Subject to these Terms, you may use AI-generated replies and photos from your chats for personal, non-commercial purposes; please don't present them as depicting real people.
6. Changes and availability
Smoochie is in beta. Features, characters and limits may change, and the service may be interrupted or discontinued. We may update these Terms; if the changes are significant, we will tell you before they take effect, and continuing to use Smoochie means you accept them.
7. Ending your account
You can delete your account at any time from your profile page. We may suspend or end your access if you break these Terms or to protect Smoochie or others.
8. Disclaimers
Smoochie is provided “as is” and “as available”, without warranties of any kind, to the fullest extent allowed by law. We don't guarantee the service will be uninterrupted, error-free or that AI output will be accurate or appropriate.
9. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to Smoochie is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not fully apply to you.
10. Governing law
These Terms are governed by the laws of [STATE], United States, without regard to its conflict-of-law rules. Nothing here removes rights you have under the consumer laws of the country where you live.
